By accessing and using SongSurf ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our service. These terms apply to all users, including space owners, playlist administrators, and song contributors.
2. Description of Service
SongSurf is a community-powered music playlist management platform that allows space owners and administrators to create AI-moderated playlists where community members can submit songs for consideration. Our service integrates with Spotify and uses artificial intelligence to evaluate song submissions against space-specific criteria.
3. User Accounts and Responsibilities
3.1 Account Requirements
- You must have a valid Spotify account to use our service
- You must be at least 13 years old to create an account
- You are responsible for maintaining the security of your account
- You must provide accurate and current information
3.2 User Conduct
You agree not to:
- Submit inappropriate, offensive, or illegal content
- Violate copyright or intellectual property rights
- Attempt to circumvent our AI moderation systems
- Use the service for spam or automated submissions
- Interfere with or disrupt the service or its servers
- Create multiple accounts to circumvent usage limits
4. Spotify Integration
4.1 Authorization
By connecting your Spotify account, you authorize SongSurf to access and modify your Spotify playlists as necessary to provide our service. This includes adding approved songs to your designated playlists.
4.2 Spotify Terms
Your use of Spotify through our service is also governed by Spotify's Terms of Service. You must comply with both our terms and Spotify's terms when using our platform.
5. Subscription and Billing
5.1 Service Tiers
- Free Tier: Limited playlists and monthly submissions
- Premium Tiers: Additional features, higher limits, and priority support
5.2 Billing Terms
- Subscriptions are billed monthly or annually in advance
- All fees are non-refundable except as required by law
- Price changes will be communicated 30 days in advance
- You can cancel your subscription at any time
- Service continues until the end of your billing period after cancellation
6. Content and Intellectual Property
6.1 Your Content
- You retain ownership of playlist names, descriptions, and criteria you create
- You grant us license to use your content to provide our service
- You are responsible for ensuring you have rights to submitted content
- We may remove content that violates these terms or our policies
6.2 Our Content
- SongSurf platform, AI algorithms, and related technology are our property
- Our trademarks, logos, and brand elements are protected
- You may not copy, modify, or reverse engineer our service
7. AI Content Moderation
7.1 Nature of AI Moderation
SongSurf uses artificial intelligence to assist in evaluating song submissions against your specified criteria. This AI-powered moderation is designed to help filter content, but it is not infallible. AI systems may occasionally approve content that does not meet your criteria or reject content that does.
7.2 Approval Modes
SongSurf offers two approval modes to fit your needs:
- Auto-Approval (default): High-confidence AI approvals are automatically added to your Spotify playlist. Lower-confidence submissions are held for your manual review.
- Manual Approval: All submissions require your explicit approval before being added to Spotify. Enable this in your playlist settings for maximum control.
7.3 Your Responsibility
You, as the playlist owner or administrator, remain solely responsible for all content played at your venue or added to your playlists.
- AI moderation is an assistive tool, not a guarantee of content appropriateness
- You should regularly review your playlist, especially before events or in public-facing environments
- You can remove any song from your Spotify playlist at any time
- For maximum control, enable "Manual Approval" mode in your playlist settings
7.4 No Liability for AI Decisions
SongSurf is not liable for any content that passes through our AI moderation system. This includes, but is not limited to, songs containing explicit language, offensive themes, or content that may be inappropriate for your venue, audience, or intended use. By using our service, you acknowledge that AI moderation is imperfect and accept full responsibility for content played through your playlists.
7.5 Appeals and Support
- Playlist owners have final authority over their playlist content
- You may contact support if you believe an AI decision was incorrect
- We continuously work to improve our AI systems based on feedback
8. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.
9. Service Availability
9.1 Uptime and Maintenance
- We strive to maintain high service availability but cannot guarantee 100% uptime
- Scheduled maintenance will be announced in advance when possible
- We are not liable for service interruptions beyond our reasonable control
9.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of our service at any time. We will provide reasonable notice for significant changes that affect functionality.
10. Limitation of Liability
10.1 Service Provided "As Is"
SongSurf is provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
10.2 AI Moderation Disclaimer
Our AI moderation system is designed to assist you in filtering song submissions, but like all automated systems, it is not perfect. High-confidence approvals may be automatically added to your Spotify playlist. While we continuously improve our technology, you acknowledge that occasional errors may occur and that you should review your playlist regularly. SongSurf shall not be held liable for content that is automatically added to your playlist, as you retain the ability to review and remove any content at any time.
10.3 Damages Limitation
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption. Our total liability for any claim arising from your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Termination
11.1 Termination by You
- You may terminate your account at any time through your account settings
- Upon termination, your access to the service will end
- Your data will be deleted according to our data retention policy
11.2 Termination by Us
We may terminate or suspend your account immediately if you violate these terms, abuse our service, or engage in illegal activities.
12. Governing Law and Disputes
These terms are governed by the laws of the State of North Carolina, United States. Any disputes arising from these terms or your use of our service will be resolved through binding arbitration, except for claims that may be brought in small claims court.

We may update these terms periodically to reflect changes in our service or legal requirements. We will notify you of significant changes and your continued use indicates acceptance of the updated terms.
